TERMS OF SERVICE (TERMS AND CONDITIONS)

§ 1 General Provisions & Company Details

  1. The online store BeatByBrick, operating at https://www.google.com/search?q=beatbybrick.com (hereinafter: the "Store"), is operated by the Entrepreneurship Development Foundation "Twój StartUp", registered in Warsaw (address: ul. Żurawia 6/12 lok. 766, 00-503 Warsaw, correspondence address: Atlas Tower, Al. Jerozolimskie 123a, 18th floor, 02-017 Warsaw, Poland), entered into the National Court Register under KRS number 0000442857, NIP: 521-364-12-11, REGON: 146433467.

  2. These Terms apply to the activities performed on behalf of the Foundation by the organized part of the enterprise "BeatByBrick", represented by Vanessa Kunawicz (e-mail: beatbybrick@gmail.com, phone: +48 534 548 726).

  3. Browsing the Store and placing orders does not require creating an account.

  4. By placing an order, the Customer accepts these Terms of Service.

§ 2 Placing Orders and Processing Time

  1. Customers can place orders 24 hours a day, 7 days a week.

  2. Clicking the "Order with obligation to pay" (or equivalent) button constitutes a legally binding contract of sale.

  3. The standard processing and shipping time for orders is up to 30 business days from the moment the payment is credited to the Store’s account, unless stated otherwise in the product description. In case of custom-made orders, the processing time will be communicated to the Customer prior to purchase.

  4. If the Store is unable to fulfill an order (in whole or in part), the Customer will be informed within 7 days, and a full or partial refund will be issued within 14 days.

§ 3 Prices and Payments

  1. All prices listed in the Store include applicable VAT (gross prices).

  2. Product prices do not include shipping costs. The total cost of the order, including shipping, is presented to the Customer at checkout before finalizing the purchase.

  3. The Store accepts secure electronic payments and traditional bank transfers. Cash on delivery is not available for international orders.

§ 4 International Shipping, Customs, and Duties (IMPORTANT)

  1. The Store offers international shipping.

  2. For orders shipped outside the European Union (e.g., to the United Kingdom, USA, Switzerland), the Customer is considered the importer of record. 3. The Customer is solely responsible for any applicable customs duties, import taxes, VAT, or other clearance fees levied by the destination country. These charges are not included in the item price or shipping cost. The Store has no control over these charges and cannot predict their amount.

  3. If a Customer refuses to pay the required customs duties and the package is returned to the Store, the Store reserves the right to deduct the return shipping costs from the Customer's refund.

§ 5 Right of Withdrawal (Returns)

  1. A Customer who is a Consumer has the right to withdraw from the contract within 14 days without giving any reason.

  2. The withdrawal period expires 14 days from the day the Customer (or a designated third party) acquires physical possession of the goods.

  3. To exercise the right of withdrawal, the Customer must inform the Store of their decision by an unequivocal statement sent via email to: beatbybrick@gmail.com.

  4. The Customer must return the goods without undue delay and in any event not later than 14 days from the day on which they communicate their withdrawal from the contract. The Customer bears the direct cost of returning the goods.

  5. Exceptions to the right of withdrawal: The right of withdrawal does not apply to the supply of goods made to the Consumer's specifications or clearly personalized (e.g., custom brick sets made from a personal photo).

§ 6 Complaints and Defective Goods

  1. The Store is obliged to deliver goods free of physical and legal defects.

  2. If a product is defective, the Customer has the right to file a complaint via email (beatbybrick@gmail.com). The complaint should specify the defect and the Customer's request (e.g., repair, replacement, or refund).

  3. The Store will respond to the complaint within 14 days of its receipt.

§ 7 Final Provisions

  1. The Store reserves the right to modify these Terms of Service. Contracts concluded before the changes come into force will be governed by the previous version of the Terms.

  2. Any disputes arising from the contract shall be governed by Polish law, without prejudice to any mandatory consumer protection rights applicable in the Consumer's country of residence.

  3. The European Commission provides a platform for online dispute resolution (ODR), available at: https://webgate.ec.europa.eu/odr.
